Project Council Statement:The Seychellois Reconciliation Project
Quote - "With each passing day, TRNUC proceedings appear to be mired in escalating and biased electioneering.
Perhaps it was naive of our fledgling Third Republic, to expect that both national exercises can run simultaneously without cross-interference.
An example of such escalating electioneering abuse of the TRNUC is the testimony of 16.11.19, where the claimant set their own claim to one side and used their airtime to expound their views on other cases, other named persons, and other testimonies. They specifically painted a rose-tinted picture of the English Colonial era, as a context to argue that the coup of 1977 unwarranted.
The influencing bias of this is illustrated by the absence of a TRNUC tv broadcast of a potential counter argument such as:
- The hereditary Monarchical English colonial regime was itself installed by violent invasion of a legitimate French Republican settlement.
- That it was done on the popular moral basis of ending the practice of slavery.
- Which moral justification supports the case for further military intervention in 1977 to end the economic slavery of impoverished humans stranded on these remote islands - a form of slavery which had replaced physical slavery. A justification reinforced by the recent statement of the political party leader in a TRNUC broadcast; where he suggested it was up to “them” to educate and work their way out of their predicament in good time.
Council holds no collective view on which argument is the “Truth”, but Council believes that the presentation of both balancing arguments must be allowed, in order to protect the integrity of the Election and the Reconciliation.
After 42 years of claiming disaffection because of a betrayal of co-habitation trust and good faith in 1977, it would be tragic if the first democratic change of administration (which is very likely to happen anyway!), occurs under the dark cloud of betrayal of trust and good faith in this genuine reconciliation process.
Council hastens to point out that the biased impact of TRNUC on the election campaigning is, in all probability, inadvertent on the part of the Commissioners.
It is a direct result of TRNUC’s need to treat Claimants and their supporting Witnesses with a presumption of integrity and truthfulness at this stage, while at the same time treating Named People with a presumption of guilt and evasiveness from the outset.
It is to be noted that:
- Claimants and supporting witnesses are treated with a required sympathy, respect and diplomacy;
- Claimant’s testimony is not subjected to cross examination or hard questions that can put a different context and motive to their narrative;
- Claimants and Witnesses who are also current politicians and political activists, have unedited and free access to express their unfettered views on national tv via TRNUC.
- Named persons testimonies, on the other hand, are subject to immediate cross examination and leading questions, with the effect of highlighting discrepancies and contradictions that can be politically exploited.
Political exploitation of the TRNUC by the alleged “aggrieved” in particular, is a sad betrayal of the investment and effort made to reconcile the human suffering endured by the deceased, injured, exiled, disappeared, and most importantly by impoverished oppressed and marginalised people.
The “aggrieved” must be mindful that the verbal gloves can come off on the other political side as well, causing families and loved ones to re-live traumatic emotions in an atmosphere of escalating hatred and mutual despise, thus serving no positive purpose.
In as much as the TRNUC is a potent weapon for election campaigning, exploiting the TRNUC deals a mortal blow to the reconciliation process.
The TRNUC Commissioners have made it clear that they are proceeding solely on the basis of their enabling Law. Implying that they disregard any collateral damage caused to the integrity of a critical and pivotal democratic election, and damage caused to the prospect of a lasting “reconciliation without winners and losers”.
The Project on the other hand is firmly wedded to the objective of reconciling the rift amongst ordinary Seychellois - to serve their best interests, and protect their sovereign rights.
The Project pays no heed to reconciling the interests of privileged elites old and new, who are significant drivers of division in the general population.
The Project does not serve the controlling interest of any power network or association.
The Project will not collude with an unethical conspiracy to sacrifice one or two individuals at the alter of reconciliation, in order to preserve the status quo of a divided, marginalised, despondent and oppressed general population.
The Project has recently received a number of enquiries and appeals from members of the public who feel helpless and damaged by what they allege are (paraphrased) malicious, frivolous and defamatory public statements made about them in publicly televised TRNUC proceedings.
All the enquiries to date involve alleged false and defamatory statements made by claimants or by their witnesses.
A common theme in the enquiries we have received, is a feeling of helplessness which we believe is derived from:
1. A perceived inability to take legal action for injury or distress caused to them;
2. A perception that the commission is acting as prosecuting agent on behalf of the claimant and therefore has no interest in prosecuting claims for new injury arising through their abuse of the process ;
3. A feeling that the burden of proof on the claimant is minimal and the commission builds the case on their behalf, with no similar counter-service offered to persons defamed or injured by the claim.
With regard to these enquiries, Project Council appeals to the commission to be more forthcoming on consequences that can be expected for making false allegations.
Council also appeals to the legal profession to provide presumed innocent Named Persons with some solace through direct advice on potential legal recourse scenarios, such as examples set out below:
1. Recourse to civil litigation: irrespective of what the governing Act of TRNUC states, no law can revoke a citizens right to access justice - as enshrined in the Constitution. Therefore the constitutionality of the TRNUC Act can itself be challenged in Constitutional Court, commencing with the filing of defamation cases (compounded with perjury) in the civil courts.
2. The governing Act for TRNUC provides the commission with discretion to grant immunity to perpetrators, but it does not grant it the discretion to prosecute perjury on a selectively basis. A claim for injury through perjury may be filed with the commission, who are obliged to seek evidence and investigate it as vigorously as any other claim.
3. The TRNUC commission itself may not be immune to civil action for defamation, libel or injury caused by material it has allowed to be broadcast or published in its proceedings. Possibly including encouragement and aggravation by non-prosecution of perjury, or by allowing irrelevant defamation under the subjective pretext of “context”.
The council is deeply troubled by the current damage caused to the prospect of “reconciliation with mutual respect, remorse and reparation”, which is a core objective of this project.
Council appreciates that the objectives of the commission differs, in that it prioritises establishing the Truth along with Reconciliation.
Council believes that the low threshold of proof required of the commission, makes it impossible to establish credible truth without claimant integrity, and without full accurate disclosure by defendants.
It is pointless to establish a convenient version of truth for the day; if it leave the traditional practices of dishonesty, deception, conspiracy and subterfuge intact in our social processes.
Council proposes that the nation considers suspending the TRNUC process for the duration of this watershed election period - to best serve the combined interests of maturing our Democracy, and achieving true social Reconciliation.

Of late those who hold the view we have become like the street people, we write and share issues normally not for sharing - it is that Truth commission phenomena, frustration, malfunctioning, what we had expected of it. From the Truth Committee of the National Assembly, while most of those who have been impacted and affected involving that Truth commission process the due rule, legal, justice process - those administering, those in office  and managing the process, they are sheltered from harm, they are financially insured, they do not or cannot be bothered the process last or drag and even the outcome. 


Very many who have addressed the Commission have refused to so far to say explain the degree and level of aggressive comportment from both camps,  the government and those who decided to oppose the system. If/had they not gone down that road the law, justice and the world would have seen most of them in the graves, dead and then exonerate their values and the existence  and function of justice and rue of law. As had/have happened in very many countries across the world. 


Take the very simple issues that of TSB Bank, Given the issue of the Polish thread, TSB was the Bank of the NGO, the Voluntary sector, ethnic minority and the marginalised, whatever grant and donation they would put them in TSB and they became specialist in their field.
