New elections needed if presidency becomes prematurely vacant

10-March-2017
New elections will be required if the Seychelles president dies, resigns or is removed from office.

In an extraordinary session chaired by President Danny Faure, the Cabinet, this week, approved for a change in the manner of succession to the presidency in the event that the post of president becomes prematurely vacant.

Letter to the Editor - The post of Vice-President of the Republic

10-March-2017
Mr Editor, I have read and heard that the Cabinet of Ministers has approved a proposed amendment to the Constitution that would require new elections if the President of the Republic of Seychelles dies, resigns or is removed from office.

Therefore, I conclude there is no need for a running mate in presidential election, no need for the post of vice-president.

Movements noticeable. From the new cadre at State House. Movements with mixed feelings. Positive change oriented considered a blessing. After almost forty years of inertia. Proponents share cautious optimism.
Others more sceptical. Past experiences. Reminders painful. That things are not what they are. With that system.
This situation demands serious consideration. Thorough analysis. To comprehend the complexities. The complications. Consequences ginormous.
The present chief at State House is not the Leader of the ruling party. Not its chairmant. He is just a member of the party. He could not decide his position. Position in the hands of the Leader of the Party. Powerless over own future. Future insecured.
He is not elected. Does not enjoy the support of the majority. He carries more support outside of his own party. The irony. Alone. Victim of the system. System he was instrumental in building. System he defended for many years.
He could be dismissed from the party apparatus. Does he vacate State House too? Could be a new frontier. Another challenge. “Political Einsteins” could elaborate on such possible eventualities. Scenarios. “Political Einsteins” on the ground.
The situation. His position. Unenviable. By any standard. How far could he move from the dictums of the party? How much leeway he has? Is he his own man? He could be a very brave man. Still. Not a lunatic. Or a “fier couillon”. (Larousse). The larger picture. Unseen. Masterminded. ‘Eminence grise’.
The other side of the same coin. It could be a strategy. Strategy to lull the Nation into a false sense of hope. Security. Confidence building. Charm offensive. Strategy well orchestrated. Choreographed.
They could be in cahoots with one another. Hand in glove. Leaders of the ruling party could live with these “minor” indignities. Painful as they are. To digest. They can still sleep. “Major” indignities to be prevented. An inconceivable option. Too fearsome. Afraid of their own medicine. The Bitter Chalice. Too many involved. From all ranks. The social spectrum. Dossiers getting thicker. Heavier.
Wheels of the law in motion. Unstoppable. They could be reversed. Though. Through a Legal “Institution”. Elections. The Paradox. The whole ongoing process of Transparency jeopardised. This is Politics. Politics makes strange bed fellows. Happenings for a reason. Thousand miles of dirt road. Still. Christmas could never come.
The Nation should resist the prevailing status quo. An Elected President is the only acceptable alternative. Legitimate President to lead a Dignified Seychelles.

John Jean In accordance to the new constitutional provision as reported in Today, the opposition can only exert a moral pressure on the President to call for a fresh presidential election and can only insist (morally) on his resignation and to call the election....See More
So, 3 years after the resignation of any president, he or she will have acquired legal immunity, or immunity from prosecution, And that is that!

We might not be still young for 2021 presidential election rallies!?

Joseph Samy Great writing!

The Problem With Politics Is When You Form A Government, You Creating A System Also. And That Same System Will Come Back To Haunt You If You Don't Leave And If The Change Does Not Apply Also.

Constitutional amendments

LDS will continue to press for presidential election

In its first reaction to the proposed Constitutional amendments, the Opposition alliance yesterday revealed it will maintain its demand for fresh presidential elections. Roger Mancienne, leader of Linyon Demokratik Seselwa, LDS, also explains that the amendments will result in immediate changes to the composition of several public bodies.

The amendment to the mode of appointment of the President in the event that the post becomes prematurely vacant will not dissuade the Opposition from maintaining the pressure on State House. In an
interview with TODAY, the leader of the LDS alliance, Roger Mancienne explained yesterday that the opposition will continue to ask President Faure to step down and to organise fresh elections.

If the amendment is adopted by the National Assembly, the practice of "Pas baton" will be outlawed. But it will not apply to the transfer of power effected in September 2016 when the then president, James Michel resigned.

"During our consultations, President Faure stressed that he does not wish the new constitutional provision to apply to his case. We disagreed on that because we do not think it was not a democratic transfer" explained Mr. Mancienne. Hence the opposition will exert a moral pressure on the President and insist on his resignation.

When asked if LDS is ready to go into the ring for a new election, in case the President resigns, Mr. Mancienne said : "We will be ready if there is a presidential election. There will be a normal process to select a candidate."

In reply to a question, the LDS leader said that in case the alliance
designates Wavel Ramkalawon as the presidential Candidate, he will not be required to resign as member of the National Assembly unless he is elected as President.

Commenting on the other proposed amendments, Roger Mancienne revealed that persons currently heading some constitutional bodies will have to quit. "In our view, the existing
heads will cease to assume office once the amendments come into force. For the Constitutional Appointments Authority (CAA), the amendment provides for two members to be named by the President and two by the Leader of the Opposition. If this is the case, then it must be the present President and the present Leader
of the Opposition. Otherwise, the composition will not be in accordance with the amendment."

As for the post of Chairman of the CAA, the appointment will be made by the President in consultation with the Leader of the Opposition. "This requires that both sides adhere to the principle
of consultation. I recognise that there is a possibility that the President will not pay due heed to the consultation process", said
the LDS leader.

Regarding members of the Electoral Commission, added Mr. Mancienne, "they are appointed from a list submitted by the CAA, so the new CAA will have to submit a new list and as the Opposition party we have a say on what names are submitted. We will press the case for a new Chairman."

Even for the SBC, the amendments will have an immediate consequence: "The proposals we have made are that members of
the Board are named by external bodies such as SIFCO and the
Citizens Engagement Platform, which we hope will suggest the names of independent members. The Chairman will be appointed
after consultation."

The LDS leader also expressed the wish that changes in the composition of other bodies such as the Human Rights Commission
and the Anti-Corruption Commission do have an immediate effect.

Mr. Mancienne also reacted to the creation of new positions in the National Assembly. "Formalising the post of Leader of Government Business simply means that that a post which existed de facto will now be enshrined in the Constitution. However, personally, I do not
support the creation of the new posts. There will be a Deputy Leader of Government Business, a Deputy Leader of the Opposition
and an additional Deputy Speaker. I do not support the package because it would be loading the National Assembly; too many posts at high level and with high salaries are created," he concluded.
