The 'Extortion' saga deepens. One person from the ACC is in custody and appeared in Court this morning on an application to hold further for investigation. It appears that there will be more arrests from the ACC. This is certainly not good news for the newly launched ACC.

Prosecution attempts to send senior officer to prison
A senior official of the Anti-Corruption Commission Seychelles (ACCS) who is being accused of "alleged offence of demanding property by written threats and official corruption" by a former minister has been remanded for another 14 days as the Prosecution failed to present enough evidence to send the accused to prison while the investigation continues.

The Prosecution suggests that the accused could tamper with the ongoing investigations if he is released on bail – hence they asked the Court to put the accused in prison while the investigations continue to prevent any tampering or interference.
The ACCS senior officer’s lawyer, Alexia Amesbury, fought hard against the prosecution on the grounds that “someone has never been sent to prison before fair trial.”
“This is the first time someone is brought to Court for Prosecution to ask the Court – not to remand the accused – but to send the accused to prison straightaway,” Mrs Amesbury tell the press after the court hearing.
“They say the accused should be put in prison under Section 179 of the law but even under that Section it says that the Courts can send someone to prison for 15 days, but the Prosecution did not specify this; they asked that the accused be sent to prison and that was the end of it – indefinitely,” she notes.
She also observes that the investigations are taking an unnecessarily long amount of time, especially in proving that the evidence held against the accused is justifiable.
“Since 5 January this year, they arrested the senior officer from ACCS and they’re telling me that until today the Police couldn’t take the handwritten letter which was used as evidence to confirm whether it was the accused handwriting? Send it abroad or find an expert who can compare the handwriting of the accused with the handwriting found in the letter to determine that it is his or not,” she suggests.
“The prosecution have also said in their application that there were telephone calls made by the accused to the complainant – could they not in fourteen days contact the telecommunication companies to find out if those calls truly took place? This as well has not been done,” she affirms.
Additionally, she says that the Prosecution say that the accused asked for a certain amount of money to be sent through a foreign bank.
“If money is being transferred, the bank will need the details of who the beneficiary is – this as well has not been determined,” she says.
The accused has been remanded for another 14 days at the Bois de Rose remand centre. He is due to appear at the Supreme Court again on 5 March 2018.
The consequences for the accused are severe; the offence could mean a fine of up to SCR300,000 and between 7-18 years in prison in the case of corruption.

We had not been aware of this Broadcast/Interview when we addressed a Private message to the newly MNA Mr Philip Arrisole late yesterday evening copy to the LDS Leader the issues of that SIROP program and its regulatory mechanism workings. .
We have addressed former, National Assembly Speaker and MNA Minister Pat Pillay our very grave concern that what were the mechanism used/applied to cause/bring about the major rift in the SPPF/PL, the government of President J A Michel and the ruthless abuse, raiding, harvesting information, skimming a massive amount of information provided to President FA Rene, government, his Ministers, global business Associates of that SIROP program - those high officials from EU, the UN, the Vatican, European governments, other world Institutions , African Union this happened and the emerging of His political party and the merger forming LDS - we have had some 30 years experience not just Seychelles around the world working this thematic. The decision to express/state that in spite of the above working the LDS Leadership and the then new National Assembly Speaker never mention one word about that SIROP program and those involved - yet and the capacity, regulatory high mechanism this program was build with and works with. The ICC and SFO issues in Britain among them.
It is very positive that Mr Chetty a former Member/Executive of SNP among others we have addressed our concern about that SIROP program in writing copy of emails never an acknowledgement - to note his University /Academic education and CV importantly he is the Consulate for two Scandinavia countries their government and Royal Family impute in that SIROP program - Chair person of Transparency International Seychelles at our SIROP Resource Page the many info and international links to information.
Of interest beside other topics he addressed was the fact that he is recruiting two person from the EU to work in the Office of Corruption monitoring, bench-marking and reporting.

The CEO of the Anti-Corruption Commission has confirmed
to LSH that the corruption cases against two former ministers and a high government official are still with the commission.
Speaking by phone to LSH, May De Silva explained that the commission has experienced a ‘slight delay’ because of the issues with one of its staff who has been investigated and charged by the police for alleged extortion.
“Because of the case against one of our staff we have suffered a setback, which has depleted our personnel but now we are back on track.”
The commission sent the cases to the Office of the Attorney General, AG, on 31st January 2018.
There were three cases and they were:
AG Case 1 - alleged abuse of position by a former minister.
AG Case 2 - alleged abuse of position and liability for corrupt acquisitions by another former minister.
AG Case 3 - alleged unlawful acquisition and misuse of public
funds by a public servant.
However the AG’s office returned the reports to ACCS arguing
that they were not in the proper format.
The AG explained that the cases should not be in the form
of a report but rather in the docket format which is the same
as the police as the ACCS is an enforcement agency.
The commission has just hired an Investigation Manager and the section is working flat out on the dossiers.
“This time we want to do it right to ensure that no accusation is
leveled at the Commission that the case is being rushed.”

President assents to Anti-Corruption (Amendment) Act, 2019 | 06 August 2019
President Danny Faure has assented to the Anti-Corruption (Amendment) Act, 2019, which was approved by the National Assembly on July 24, 2019, and received by the President for assent on August 1.
The primary purpose of the amendment is to give the Commission greater powers to fight corruption.
The amendment to the Act will give the Commission the same rights, powers, authority, privileges and immunity as are already available to the Police to detect, prevent and investigate offences under the Act.
The Amendment will also enable the Commission itself to undertake prosecution for corrupt practices.
