Eight months after the appointment of the administrative Tribunal which has the mandate to look into cases where government has taken land from members of the public since 1993, no office and budget have yet been allocated to allow the Tribunal to start operation.
The Tribunal chaired by Joseph Athanasius was appointed in August 2017.
According to Danny Faure, his decision as the head of the executive to establish an administrative tribunal followed a ruling of the Court of Appeal of 7th December 2012.
The tribunal will have the mandate to resolve all cases of compensation related to land in line with Part III of Schedule 7 of the Constitution.
But to date no necessary funds have been set aside for the tribunal to perform its duties effectively, including an allowance to the five tribunal members.
According to Athanasius, the tribunal’s power which will allow it to settle the land dispute will be derived from the Presidential Administrative Order.
He explained that the Tribunal legal framework doesn’t have to be established through a Statutory Instrument (S.I) or a law that has to be approved by the National Assembly.
However it is not known how far reaching will be the powers of the Tribunal including whether it can propose further reforms.
The other Members of the Tribunal are Hubert Alton, Roy Cadence, Alain Savy, and Sabrina Zoe who is also the Secretary to the Tribunal.
