Maurice est le seul pays dans la région et en Afrique qui dispose d’un cadre légal sur l’arbitrage international épousant les normes établies par l’United Nations Commission on International Trade Law. L’île a adopté en 2008 l’International Arbitration Act, loi qui permet aux parties internationales d’opter pour la destination comme lieu neutre pour pratiquer l’arbitrage. Notre juridiction se positionne comme une destination de choix pour régler les différends commerciaux, ciblant une clientèle venant essentiellement de l’Afrique anglophone et francophone.

À l’échelle de l’Afrique, Maurice a, en effet, une bonne longueur d’avance pour se démarquer comme un centre de référence dans le domaine de l’arbitrage international, une méthode discrète et rapide de résolution des différends dans les accords commerciaux internationaux. Car de plus en plus, les parties qui sont en conflit font le choix d’opter pour un arbitre, soit un professionnel formé aux lois régissant l’arbitrage, au lieu de frapper aux portes des tribunaux.
